Terms of Service
Effective October 4, 2026
These terms are an agreement between you and Scott Neidig, doing business as Business Profile Builder ("we", "us"), which runs MindMaxer at mindmaxer.com. By creating an account or using MindMaxer, you agree to these terms. If you don't agree, don't use the service.
1. The service
MindMaxer is a spaced repetition flashcard app. You create or import cards, study them, and rate how well you knew each one. We may add, change or remove features over time.
2. Your account
You need an account to use MindMaxer. Give us an email address you control and keep your password private. You're responsible for what happens under your account. You must be at least 13 years old to use MindMaxer, and if you're under 18, a parent or guardian must agree to these terms for you.
3. Plans and billing
The free plan holds one deck so you can try the app. Pro is a paid subscription, billed monthly or yearly at the price shown when you subscribe. Payments are processed by Stripe. We never see or store your full card number.
Subscriptions renew automatically. Your card is charged at the start of each billing period until you cancel. You can cancel any time from the Billing page. When you cancel, you keep Pro until the end of the period you already paid for, and you aren't charged again.
We may change prices. A new price applies to your subscription only from your next renewal after we've given you notice, so you can cancel first if you'd like. Refunds are covered by our Refund Policy.
Lifetime accounts are given at our discretion, for example as gifts. A lifetime account gives Pro features for as long as MindMaxer operates, at no charge. It can't be transferred or exchanged for money.
4. Your content
Your cards, decks and notes belong to you. You give us permission to store, process and display them only so we can run MindMaxer for you. You can export your cards as CSV files at any time.
Don't put anything in MindMaxer that you don't have the right to use, or that's illegal. You're responsible for your content. Please don't store highly sensitive information in cards, such as passwords, card numbers or health records.
5. Acceptable use
You agree not to:
- break the law or anyone else's rights while using MindMaxer;
- try to access other people's accounts or data;
- probe, scan, overload or disrupt the service, or get around its security or limits;
- copy, resell or build a competing product from MindMaxer's software or design;
- use bots or scripts to access the service, other than the built-in export.
6. Suspension and closing accounts
You can stop using MindMaxer and ask us to delete your account at any time. We may suspend or close an account that breaks these terms, puts the service or other users at risk, or is required to be closed by law. If we close a paid account without cause, we'll refund the unused part of the current billing period.
7. Availability
We work to keep MindMaxer running and your data safe, but we don't promise it will always be available or free of errors. Keep your own copy of anything important. The CSV export is there for that.
8. Disclaimer
MindMaxer is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee any learning, exam or career result from using it. Study charts and forgetting curves are estimates.
9. Limitation of liability
To the fullest extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or revenue, arising from your use of MindMaxer. Our total liability for any claim related to MindMaxer is limited to the amount you paid us in the 12 months before the claim, or $50 if that's more.
10. Indemnity
If someone brings a claim against us because of your content or your breach of these terms, you agree to cover our reasonable costs of dealing with it, including legal fees.
11. Changes to these terms
We may update these terms. We'll post the new version on this page with a new effective date. If you keep using MindMaxer after that date, you accept the new terms.
12. Governing law
These terms are governed by the laws of the State of Colorado, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts in Colorado, unless the law where you live gives you the right to bring it elsewhere.
